Can you buy a house that is still in probate?
Often, yes. In Minnesota, a personal representative appointed by the court generally has authority to sell real estate as part of administering the estate, depending on the will and the court's order. We have bought homes that were still in probate. We work with your attorney and the personal representative to make sure the sale is consistent with the court's requirements. If the estate is not open yet, we are happy to wait until it is, or simply stay in touch until the family is ready.
What if my siblings and I do not agree on selling?
That happens a lot, and it is normal. We are patient. Sometimes a written offer in hand actually helps a family make a decision, because now there is a concrete number on the table instead of a hypothetical. We will share the offer, answer questions, and give the family time to talk. If the answer is "not yet" or "no," we do not pressure you.
Do we have to clean out the house first?
No. You can take the belongings that matter to you, and leave the rest. We will handle cleanout as part of buying the home. A lot of Twin Cities families find this part of the process a huge relief, because sorting through a parent's lifetime of belongings while grieving is exhausting.
What about back taxes or liens?
We are used to these. Minnesota property taxes, mortgage payoffs, mechanics liens, and HOA balances all get handled at closing through the title company. You will see everything on the closing statement before you sign. If a situation is complex, we will walk through it with you and, if appropriate, your attorney.
Do we have to pay any fees or commissions?
No. We buy the property directly from the estate or family. There is no agent, no listing fee, and no commission. Standard closing costs handled by the title company are typically paid by us on these purchases, and we will confirm that in writing on the offer.
How is this different from listing with a real estate agent?
Listing with an agent can make sense if the home is in great shape and the family has time and energy to stage, show, and negotiate.
